About Deportation

Deportation Basics

Deportation takes place when the United States government removes an alien from the U.S. and returns the alien to his or her country of origin.  If you are an alien who has violated U.S. immigration laws or if you are facing certain criminal charges, you may be subject to removal from the United States.  When a deportation proceeding is instituted by the U.S. Department of Homeland Security an immigration judge will hear your case to determine whether you are removable from the U.S.

Even if the immigration judge finds that you are removable, the judge may still determine that you are eligible for relief from removal and issue an order granting such relief.  In the event that the immigration judge does not find you eligible for relief and orders deportation, the U.S. Immigration and Customs Enforcement (ICE) will complete the removal process.

The U.S. Immigration and Nationality Act sets forth certain categories under which an alien can be removed from the U.S.  These categories include:
